CyberFM
For starters, it is illegal to use the word shoutcast in a .com domain name. Is that true? really? LOL .. I own "ShoutcastI.com"

CyberFM
didnt you guys have some trouble with shoutcast.com a while back? Probably the old resellers. We had bought the domain name/web site/and handful of customers from (apparently some kids) for about $50. We then booted the customers and restarted... it's doing fine and pays the bills. It has our *actual* brand name behind it now so that probably got everyone's confidence up. But I've never heard of being sued or getting in trouble for having a name in your domain name. ever vist paypalsucks.com or otisfordsucks.com ? The entire point in Net neutrality right? Though true, this is the only domain name we own that has another name within it... just seems odd. I'm pretty sure if Shoutcast wrote us some sort of C&D Letter, I'd just fwd it to my lawyers and place a lunch wager that NOTHING comes about it. Edit: I actually should have summed up with: I'm not sure *anything* is considered "Illegal" by any standards, short of geographic laws. Although its sad.... it is true, that although Child Porn is "illegal" in the United States, I'm willing to bet that there's a country out there, that allows it... and if that's the case and their dedicated server is within that country, there's no case at all. on the other side, you can use ANY Nigerian 419 Scam as an example... basically NOT ILLEGAL, because of the fact that it's online and across international waters. It can only be called a "scam"
kwdservices
.Is that true? really? LOL .. I own "ShoutcastI.com" To the best of my knowledge it is. I could list at least 5 or 6 people with the word shoutcast in it that got their domains pulled by AOL, one of which was someone I knew personally and they gave me that information. Some of these people were hosts and others weren't, so it's not like AOL is only doing this to people trying to make money. I haven't personally talked to AOL regarding this, but I am pretty sure that this is true. I would recommend talking to an attorney to check if you are compliment, can't hurt (well actually it might hurt your wallet, but...)
CyberFM
Oh I found: Please Dont Link To Rivals Sites - Admin I see, AOL used the cybersquatting precedent set forth by Madonna to take the name from them. So no, in reality, it's not "illegal" (one does not and CANNOT go to jail for it)... AOL has the opportunity to sue someone CIVILLY in the United States for "Cybersquatting" I bet a good amount of money that they were intimidated by a typical C&D Letter and simply did NOT have the funds to win that CIVIL lawsuit. SO they let the name go. I can officially state that my opinion is, "No" it is NOT "illegal" to have "shoutcast" within your domain name. It IS INDEED "Cybersquatting" if you sit with the name and do NOT use it for the intentions it is designed for. So yes, if AOL came after me for shoutcasti.com it would definately hurt my wallet defending my domain name. But here's a secret, after they LOSE that case, my suit back for damages would be beautiful. I am in two moods right now... I'm in the mood to go buy PepsiSucksInMyOpinion.com and go sue the guy who owns cyberfm.com
CyberFM
Wanted to add for all of us. If you reside in the United States, tell your friend to get his domain name back, and few million dollars in damage ;) http://www.aplegal.com/articles/article2.html This lists out all of the USC Penal Codes, Case Precedents, and Policies against "Reverse Domain Hijacking" where a major corporation intimidates a legitimate user with "CyberSquatting" Pretty cool, I learned a lot, it's like "Affirmative Action" on the Internet. aaronsnet
Totally fine Yes it is a rival site, id usually allow it. So he could've only included a link example if that site was linking back? That site wasn't even participating in the conversation. How funny. Just one of the many reasons I will never fully put my faith into this site. James
Just one of the many reasons I will never fully put my faith into this site. I am not even going to go into detail about this. Take note of what forum you are posting in and what section. And i ask nicely to stop trying to bring down fellow members and myself on here, this place is to discuss topics related to broadcasting and we dont want anybody spoiling the party. :biggrinthumb: CyberFM, since you own shoitcasti.com. Has AOL contacted you at all? By the looks of it you have a good statement at the bottom of the site saying the word shoutcast is copyright to AOL etc.. In my opinion (not a very good one) you should be fine Studiio - All-In-One Radio Communication Platform SMS | Phone Calls | Social Media | Content
