CyberFM
I thought you were all in a business, but apparently this is a hobbysist site. You don't earn a living from your business... it pays your cell phone bill? I can't be bothered, none of you have enough common sense to understand Brand Name issues. Closed the thread, like you live in Cuba. Good bye guys. James, can I have the $9 back (or send me $4 back to offset the anger over the $5 domain name). As for CHQ, you guys unfortunately just cost him a lot of money (he doesn't have, defending himself) FORTUNATELY, I have the money to piss away just making his life hard. (Although you will see I made him a nice offer in the thread that is now closed) As for the "Typical American" Comment from "BoxOVoices" -- There's a reason why we are "American" and that was uncalled for. GKREurope: I followed your instructions step by step. MFTU comes back to CyberFM. Thanks for aiding me in wasting 5 more minutes in life. So for all you hobbyists, piss off. For all of you professionals... Good Luck! Protect your business from children. --HottWeelz Out.

I hope it serves you well. It is a great attitude that I have... thank you. I meant no personal disrespect to you, however, yes "hobbysists" need to respect the "business side" of the world. By not respecting it, where exactly is your "love for it" ...you would not have the love of it, as a hobby, if it werent' for the businesses backing you up on it. You think it's your royalty fees helping the industry, no, it's not. Its ours. be thankful. Hobbyists, request FREE Voiceovers... Business PAY for them. Everyone remember that. fridaynightsmoke
Just to chip in my 2p here.. I'm not in the radio business, but I AM in business nonetheless in the UK, and I do know a little about UK trademark law. CyberFM, whatever case you think you have in a US court, you have no way of making it stick, or affecting someone in, the UK. US court judgements DO NOT APPLY in the UK, and vice-versa; they're different countries. If you DID want a judgement that would stick against 'chq', you would need to do it in an English court. You have NO CASE under English law. The only concieveable way you would have even the beginnings of a case is if you had your trademark ("Cyber FM") registered with the UK Intellectual Property Office, or if you could demonstrate that 'cybaFM' was "passing off" as 'Cyber FM', AND you could demonstrate monetary losses because of that. Now, I'm not taking anyones side here; I think you've both been utter cocks at different times during this saga, yet 'CyberFM' your attempting to strong-arm a fairly-won domain out of someone with all this legal bull you KNOW doesn't apply leaves a foul taste in my mouth. The funniest part is how you imply that you're some high-flyer (having mentioned working 'on Wall St') yet you are worried about your $9, the price of a decent sandwich. Pack it in the both of you. The $9 reference is more of a smack on the shoulder, you dig? Apparently, no one as of yet, has had any knowledge about typosquatting/cybersquatting here huh? Jinglemaster
What an insulting thread. Ironically talking about children as he throws the toys out of the pram. I am gobsmacked. A lot of professionals give up spare time to help here and when people like you make remarks like that it just makes me and I am sure many of the others all the more determined to carry on and rise above the steaming pile of SH!T you just left in your wake. Apparently, no one as of yet, has had any knowledge about typosquatting/cybersquatting here huh? The main cause for alarm was the TIMING of the purchase of the name. The "I" in IANA stands for "International" Typosquatting/cybersquatting is treated as trademark infringement under UK law. You would need to demonstrate the registration and/or use of a trademark in the UK to have a case. A case in the US does not apply whatsoever. The 'I' in 'IANA' stands for 'Internet', actually, and they have nothing to do with domain squatting disputes. Quoting you: Regardless of age, although most likely a legal adult in his country, can someone else possibly chime in and explain the ramnifactions of having a Civil Judgment against a person? I'm obviously not getting myself across correctly to CHQ's mind am I? Can someone else explain that a Civil Judgment affects your Credit Score, your ability to obtain a mortgage. It affects your personal life for a mininum of 7 years if paid off timely?A civil judgement in the US has absolutely no legal force in the UK, whatsoever. You would need a UK court to award you with damages. Without that, there is no way anything you do could have financial or legal repercussions on 'chq'. The VERY BEST you could hope for is the US company that assigns .fm domains transferring the domain in question to you from him.
CyberFM
You are correct, my mistake. BUT demonstrating the use of the Domain in the UK is quite easy no? Trademarks and Branding are handled through the World Intellectual Property Organization via the United Nations when on an International level... I believe. I won't know all facts, until AFTER speaking with lawyers of course.
fozzy
Not Sure whats going on here but i take it its about a domain name? cybaFM & Cyber FM Yes? mrbook
Reading through the back and forth in the other thread "cyber" if you are really serious about this I would not discuss anything more on an open forum but would instead talk to your lawyers that from the atitude that you put forth can afford several of them and have them go through the motions of your "war" with "cyba". seriously calling us a hobbyists like we're some low level sub-species is very insulting to your holy then thou way you put yourself out as, don't take this the wrong way I'm happy for your success but don't come on here thrashing the hobbyists and hopeing that we would see the light and get on your side of the argument. I think James should close this waste of bandwidth thread and if you want your price of a latte at starbucks money back contact him via PM or email, and now in the words of Mr. Bale "I'm done with you professionally"
kwdservices
Just thought I'd chime in here, and I am hoping this doesn't turn into me asking to get mobbed.....I am on no one's side, and am just posting some thoughts I had. The internet is based on competition, without it, who knows what would happen. If Microsoft decides to sue "Mike Row's Software" for copyright infringement, be my guest, but somehow I highly doubt that that same case would get anywhere between two small businesses. I could be wrong, but this is my view from things I have seen. For example, our company created the 000 brand for one of our radio stations, and the next thing you know, some random person in Las Vegas, Nevada decides he's going to register as many domains related to radio and music with 000 in it. Personally, I really don't like this, but it is a complete waste of our time to even tell him to hand the domains over. 99% of the time, a law suit is a waste of both parties' time, but for some reason Americans seem to enjoy suing each other over pointless things, such as, "My cup of coffee from McDonalds was too hot." So honeslty, I think this is an argument that is getting both of you nowhere, and now when searches are done on CyberFM, people are going to see this thread and wonder about the character of everyone who has posted in it. This is just my personal view on this and 2 cents. Take it or leave it, but I am NOT getting into any sort of argument with anyone regarding this. Try taking a deep breath and enjoy life for what it is, to everyone in this thread, and I hope everyone enjoys his or her weekend

CyberFM
Either way, as i stated in the first line, "I THOUGHT THIS WAS BUSINESS ORIENTED" I was wrong, this site is intended for hobbyists, hence my goodbye. I have no desire to hang out with Hobbyists.... I think, obviously, the reasons are readily available. I don't fit in, in a hobbyist site... re-read my very first line, I'm a little in shock that the majority here were hobbysists, but this explains a lot. So, hobbyists, don't take it personally... Jinglemaster
I have just read the original thread. The words ' LIFE, A and GET' spring to mind. They just need re-arranging into a useful bit of advise for you. At what point did you think that you own the rights to all things Cyber, Cyba etc? I will search for SYBER and SYBA later and register them just to spite you myself. Pathetic. Utterly pathetic.

GKIye
Pardon Me to make a reply to this issue "once again" Guess what ? I was wasting yesterday evening a whole evening (and not 5 minutes) to your problem in trying to achieve a solution to the discussion between you both. - The links and details that I provided into my messages where correct and true - search, open your eyes and you gonna see - These endless discussions are part of the reason why members left other forums - Your domain isn't your domain ! Is that clear ? Its registrated to Adam G, so this person is the physical owner of the domain cyber-fm.com and is the only one who can take part to this subject .. to my knowledge of earlier posts your name is James - if this is not correct I apologize - About all the great details you wrote about laws etc etc ... Well I have a good one for you .. You are against the law. Why ? Because at NO place neither cyber-fm neither at your MFTU website you mention a logo, redirectlink or details about any royalty agency. Your ID of the royalty agency has to be visible on your website where you offer streaming media at any time. THAT is the law in Europe and please feel free to discover some "official" European streaming projects who are paying their Monthly contributions - For your records I don't gonna piss off .. Please give some respect to fellow members who are already far more longer active into the world of Media and Radio than you are. I started radio in 1978 !! To my details I started already radio at the time you where 3 years old ! GKREurope: I followed your instructions step by step. MFTU comes back to CyberFM. To Smokey Your reply was what I was trying to explain several times in some kind words during the disccusion that Cyber made to a fellow member. I agree no US laws affects citizens of other countries, and certainly not to them living at Europe .. afterall the UK is also part of that Just to chip in my 2p here.. I'm not in the radio business, but I AM in business nonetheless in the UK, and I do know a little about UK trademark law. US court judgements DO NOT APPLY in the UK, and vice-versa; they're different countries. If you DID want a judgement that would stick against 'chq', you would need to do it in an English court. You have NO CASE under English law. In general I wanna say : I admire and respect US citizens who are into the media biss, to Europeans it looks sometimes that they have better skills in voice and studiowork etc However "some" of them are still thinking that they are living in the biggest country on this planet. The truth is that no country in the world (unless some African republics) are almost bankrupt .. the US is almost and close to the edge .. If Cyber knows anything about Wall Street .. please inform yourself about the Dow Jones, that one is currenlty at 7141.86, the limit of a crisis is 8000 equal to the lowest rate reached during the big reccession of the 1930s, that rate is below of 8000 since the end of the Summer 2008 My conclusion is simple ..
