Since the music/audio is on demand and can be listened to whenever, they cannot be offered as the same licensing. Unless you have FULL rights/written rights and/or the band is INDIE, you will be fine. Or if its just a talk podcast, you need not to worry. However, if you broadcast a podcast with copyrighted material, and you get caught, the fines are in the thousands!!!! -JB Jon Bova "Successful people have libraries.
