cr08
So this question is more tongue-in-cheek than anything as my gut instinct tells me this leans WAY over into legally impossible or cost-prohibitive territory. But figured I would ask for the edumucation anyways. Essential thought is this: Recordings made of a given commercial terrestrial station and offered up in delayed playback in an on-demand fashion with no direct information given as to the content beyond station name, show, and air date/time of clip. More or less podcast style but the content would include copyrighted music and possibly other necessary material to the show. Given the hefty fees and legal issues surrounding intended live internet rebroacasts of terrestrial stations existing now seems to nail this one imho already. But interested to hear from the seasoned guys here on this.
Spinny
Interesting question and I am not totally sure of what you want to do, nor do you say how you are currently licensed, however, if you are currently covered through a blanket license provider, than you would have to pose this question to them. With copyrighted music being played on a delay without being able to pull the data through the license provider directly with the limited information available for the broadcast, I am betting you would have to manually fill out the form provided by the license provider on what music was played. These forms are specific and must be filled out properly to be accepted by the system. And that's only if what you want to do can be done legally. If you are covered through a blanket license provider, I would send this question to that company (loudcity, streamlicensing, live 365, etc) and see what they say. If you don't have a blanket license and deal directly with ASCAP, SESAC, BMI and Soundexchange, you would have to contact them. Tom
cr08
Well, this is just theoretic more than anything related to an idea that had crossed my mind. Essentially the key part is on demand (not streamed) access to what is more or less chunks of recorded audio from a given commercial FM station, all entailing (ie: copyrighted music, jock VOs, advertisements (this is iffy), etc..). More or less as if I took my personal FM tuner, piped it into my PC, recorded an hour or two from a local station, and offered it up for playback anytime online. Not only does the on demand aspect seem to be rocky in this business unless you are a big player with deep pockets, but the FM 'restreaming' online seems to carry hefty fees compared to a native internet station, and getting permission from said stations who may have to pay said fees in return. My gut instinct tells me this is just bad legal mojo on any levels, but if there is any sort of opening it'd be cool!
