License for a station streaming over me

So I am launching a radio station with my school and for the first couple of weeks, we want a local radio station to stream over us when we are off air. Would I have to get a music license of some sort even if it is not my station playing the music but it would be through the other radio station?

 

Make sense?

When you are 'on air', I am assuming that you are archiving these performances for replay...are you licensed for that?

No i am not licensed and that is what I am asking for. do I/where do i get the license?

 

Try http://www.streamlicensing.com/ That's about the only place for licensing.

Rebroadcasting an FM station is probably not legal. You may want to consider either:

 

1) Redirecting your listeners to the FM Station's own website if you're off the air, OR...

 

2) Building your own playlist that loops when you're off the air

 

Besides the sticky legal issues of retransmitting an FM signal, the metadata on the retransmission wouldn't be there - meaning automated logging for royalty reporting would not be possible.

Depending on which country that you are located in, which country your streaming server is located in and which country your FM broadcast was in, would determine which licensing organisation that you will be required to use. For example StreamLicensing is a US company. OFCOM would be for the UK. APRA/AMCOS in Australia, New Zealand. There are many others, but again it all depends on where you broadcast.

Yes, that would be correct. Apparently you can rebroadcast your content legally, as long as you use your own station IDs in the rebroadcast and the entity that is rebroadcasting your content is also licensed. http://goo.gl/nIkiCx

In the USA, the answer would be "It depends..."

 

1) Commercials, and music used in commercials, may only be licensed for Over The Air broadcast.

 

2) OTA signals don't provide you with ANY metadata for royalty reporting and DMCA compliance

 

3) If the FM station carries news, syndicated shows, or NFL/NBA content, you can actually serve time for rebroadcasting it under your own banner/logo. Not to mention the fines...

 

Your question is fair, but you should be aware that copyright law is a minefield and unless you have all your legal ducks in a row, I would avoid doing something like this. But that's just my opinion. At the very least, you should have an open conversation with the FM station in question.

 

It's also my opinion that, when it comes to the matter of rebroadcasting a terrestrial station's content, legal advice is probably best obtained from a qualified attorney and not a forum.
